What Can I Do Legally if Husband Is “framing” Stepson?

Question by eabood: What can I do legally if husband is “framing” stepson?
I am married with three children that are not my husband’s. My son at the end of the year got caught experimenting with pot at school. It was a first time offense and was kindly put into a “diversion program” by the county that would provide him with counseling and avoid a record. If my son fails a drug test or is found with paraphernalia before the program is ended next month, he must face a judge as if he was never in the program.

Now, my husband and I have been fighting and at the request of arranging for a legal separation he threw his crutch at me (has a broken heel) and I called the police. My husband woke me up to try and get my son in trouble by lying that he broke curfew last night when I had a full on personal conversation with my son in his room knowing he did not break curfew. Today my husband has conveniently found drug paraphernalia in my son’s room. There is a good chance they are indeed my son’s items, but I am afraid that at further investigation I may find that my husband planted them himself to get my son in legal trouble as payback for me calling the cops. If I find that these items were planted what options do I have? I need to protect my family. My children come way before my husband.

You need to know. Do your investigating, and if needs be, leave your husband. Good luck
